Model Withdrawal Form

When You Can Use This Form

EU consumers have a right under Directive 2011/83/EU (and the implementing national law, e.g., the Polish Consumer Rights Act) to withdraw from a distance contract within 14 days, without giving any reason.

Important — digital content exception (Art. 16(m) of Directive 2011/83/EU, as amended by Directive (EU) 2019/2161; Art. 38(1)(13) UPK). For digital content supplied without a tangible medium, the right of withdrawal is lost only where all three of the following are met: (a) performance has begun with your prior express consent, (b) you acknowledged that you thereby lose the right of withdrawal, and (c) you received confirmation of the contract, including confirmation of that consent, on a durable medium (normally Apple's purchase receipt email). When you start your My Evening subscription, the in-app paywall asks for that express consent and acknowledgment before Apple's purchase sheet. Where all three conditions are met, the right of withdrawal does not apply. If you believe any of these conditions was not met in your case, you may still submit this form within the 14-day period and we will assess your withdrawal against them.

If you did not give that consent (for example, if you have downloaded the app but never opened a subscription session), or if your local law preserves the right of withdrawal in your circumstances, you may use this form within 14 days of the contract date. App Store refunds are handled separately by Apple at reportaproblem.apple.com.

Consumers outside the EU/EEA. This 14-day form is the EU/EEA right of withdrawal under Directive 2011/83/EU and does not apply elsewhere. Australian consumers do not use this form — your remedies arise instead under the Australian Consumer Law (the non-excludable consumer guarantees described in § 19 of our Terms of Service). UK consumers may have a separate cancellation right under the Consumer Contracts Regulations 2013 (subject to the same digital-content waiver; see § 18 of the Terms). US and all other consumers should request refunds through Apple's refund flow at reportaproblem.apple.com.

How to Send

You can submit the completed form by:

  • Email to legal_myevening@rongan.me (preferred — we will send a confirmation of receipt within 1 business day)
  • Postal mail to the address above

If your withdrawal is valid, we will reimburse all payments made for the contract without undue delay and no later than 14 days after the day on which we are informed of your decision to withdraw, using the same means of payment you used for the original transaction (your Apple ID payment method, refunded through the Apple App Store), at no additional cost to you. If the App Store channel cannot process the refund within that period, we will reimburse you directly by another means expressly agreed with you, again at no additional cost to you.
